About the role

Discord is hiring a Senior Litigation Counsel to join its legal team in the San Francisco Bay Area. You will report to the Director, Global Litigation, and work within a lean team where you will carry significant responsibility from day one. This position requires a seasoned litigator who can operate independently on complex matters, set strategy, and engage with courts, regulators, and opposing counsel. You will manage a diverse portfolio, including state attorney general lawsuits and investigations, while collaborating with cross-functional partners to protect the platform and its users.

Responsibilities

  • Defend Discord in state attorney general lawsuits and investigations, including responding to civil investigative demands and subpoenas.
  • Develop case strategy and supervise outside counsel on dispositive motions, injunction proceedings, appeals, and venue questions while managing budgets.
  • Drive resolution efforts by preparing settlement analyses, negotiating terms, and partnering with Product and Safety teams to assess proposed commitments.
  • Oversee discovery on major matters, including productions, protective orders, custodial interviews, and data collection with Data Science and Engineering.
  • Monitor new and changing laws related to online safety, privacy, and platform design to anticipate evolving litigation risk.
  • Partner with Product, Public Policy, Trust & Safety, and Communications teams on engagement with regulators and government officials.
  • Keep Legal leadership and executives informed through clear status updates and decision memos, and help build frameworks and playbooks to help the team scale.
  • Serve as a versatile member of the litigation team, willing to pitch in on matters outside core areas when priorities shift.

Requirements

  • J.D. from an accredited law school and active bar admission in at least one U.S. jurisdiction.
  • 10+ years combined experience at a well-respected law firm and in an in-house legal department, with tech experience preferred.
  • Hands-on experience leading government enforcement matters, such as state attorney general actions or investigations.
  • Experience leading complex litigation through dispositive motions, injunction proceedings, and appeals, and directing multiple outside counsel teams.
  • Working knowledge of internet platform liability, including CDA 230 and the First Amendment, as well as minor safety, privacy, and consumer protection law.
  • Ability to navigate legal issues with a practical and commercially sensible mindset, balancing litigation risk against business realities.
  • Excellent written and oral communication skills, with the ability to tailor messages to various audiences.
  • Ability to manage multiple high-stakes workstreams simultaneously and prioritize effectively.
